集合住宅地区 : (追記) コンドミニアム入館時のコロナ検査テストチェック (特に外国人居住者)
集合住宅の出入り時に、ゲートで、コロナ検査 (Covid-19 swab tests )をしないといけない という取り扱いをしても構わない と上級相が述べた。
つまり 陰性証明を提示しないと入館を認めない というルールを集合住宅管理組合/管理組織が採用しても、政府は特段問題としない ということのようだ。
The management of residential areas and condominiums are allowed to make Covid-19 swab tests a compulsory requirement for tenants, especially foreigners before they are allowed into the premises.
「とりわけ外国人に対して」 とも書いてある。
自分の家に入るのに 陰性証明を守衛に提示しないといけないなんて 私権の制限になるんじゃないか、とクレームを出す向きもあるが、政府としては 非常事態宣言の下では国民の健康維持の方が優先すると考えているわけだ。
ちょっと気になるのは コロナ陽性でも無症状/軽度の場合は 自宅での検疫隔離もオッケーになっている点だ。
となるとガードマンとしても 陰性証明保持者以外は入館を認めません と言えないんじゃないか。
居住者が自宅コンドミニアムに出入りする都度 毎回Covid-19 swab tests をするとか、アップデートされた日付の陰性証明書を守衛に提示しないといけないなんて、おそらく 実効性に乏しいだろう。
すると 一般のコンドミニアムに住むMM2Hについては影響はなく、外国人労働者の住む集合住宅でのコロナ拡散を防止するために活用される程度だろう、と思いたい、が 果たしてどうだろうか？。

野党の一部議員からは 猛反対の声が出ている。
外出/仕事に出て自宅に戻るのに、いちいち、どうしてコロナ検査を受けないといけないのか、
検査費用は誰が払うのか、低所得者層にとっては そんな余裕はない、
などなど だ。

Malaysians will not have to undergo swab tests to enter their homes in condominiums or apartments, senior minister for security Ismail Sabri Yaakob announced today, clarifying his statement yesterday.
上級相は 昨日の声明で述べた「コンドミニアム入館時のSwabテストファーストは(外国人もマレーシア国民)も適用される としても政府としては 問題としない 」という内容について修正し「マレーシア国民はSwabテストファーストの対象外」であることを明確にした。
He had said then that managers of condominium or apartment buildings had the power to bar residents unless they underwent Covid-19 testing – a move that was criticised by opposition MPs and activists.
野党議員からの批判に対応したものだ。
“I have made it clear there is no policy from the National Security Council that anyone who wants to enter a condominium or any residential area must undergo a swab test first,” he said in a statement today.
“However, the government does not stop the management of condominiums or residential areas from making a ruling that foreign nationals have to get tested in order to maintain the safety of the residents in their area.
外国人の住人については 居住しているコンドミニアムなどの住居に 仕事先/外出先から戻ろうとするたびに Swabテストを受けてコロナ陰性であることを確認しないと 建物に入れない という取り扱いを住宅管理組合/運営会社が運用しても、政府としては 問題としない。

His statement came after reports that the management of several condominiums had made it mandatory for residents to get a Covid-19 test first – a move which legal experts say is unlawful.
上級相の声明の背景だが、いくつかのコンドミニアムの運営会社が住民に対しコンド入館時の都度コロナ検査を義務付きする取り扱いを開始したが それに対して法律専門家から そのような義務付けは違法だ、という声が上がったところにある。

The Malaysian Bar said today the managements of strata properties, such as apartments and condominiums, cannot screen and deny entry to non-Malaysian residents for Covid-19 under existing laws.
Its president Salim Bashir said the Strata Management Act 2013 (SMA) did not permit the joint management body or management corporations to demand that residents undergo such tests and bar entry to those who refuse to comply.
外国人に対してそのような取り扱いをすることは区分所有法上、違法だと弁護士協会は言っている。
