高裁がナジブの有罪の判決を下した。

RM42mil misappropriated from SRC International Sdn Bhd, a 1MDB subsidiary.

1MDBの子会社から42ミリオンリンギの横領/流出事件に関する罪状として以下の全てについて有罪とする判決内容だ。

職権濫用罪　(1件)
背任罪　(3件)
マネーロンダリング罪　(3件)

これらの有罪に関する量刑の範囲は、次のとおりだ。

He faces 

imprisonment of up to 20 years and a fine for the abuse of power charge; 

職権濫用罪については、最高20 年までの懲役　および罰金

up to 20 years’ prison, whipping and a fine for the three CBT charges;

背任罪については、最高20 年までの懲役、ムチ打ち、および罰金

 and up to 15 years in jail and a fine for the money laundering charges.

マネーロンダリング罪については、最高15 年までの懲役および罰金

その上で言い渡された具体的な量刑は以下のとおりだ。

1) The charge under Section 23 of the Malaysian Anti-Corruption Commission (MACC) 2009 on abuse of power – 12 years and a fine of RM210mil, in default five years' jail.

職権濫用罪: 12年の懲役　および　罰金210mRM

2) Criminal breach of trust (CBT) with respect to all three charges under Section 409 of the Penal Code – 10 years each.

背任罪: 3事案につき　各 10 年の懲役

3) With respect to all three charges under Section 4(1)(b) of Anti-Money Laundering Act, Anti-Terrorism Financing Act and Proceeds of Unlawful Activities Act – 10 years each.

マネロン罪: 3事案につき　各10 年の懲役

Justice Nazlan ordered for all jail sentences to run concurrently.

なお、このセンテンスにあるconcurrently だが、日本の刑法でいうところのどれに類似するものなのか、( i.e. 併合罪、包括一罪、科刑上一罪（牽連犯）)  はわからない。

なお、英国法では　以下(参考)のようだ。　

マレーシアの刑法は英国法を引き継いでいるだろうから、そうすると　懲役年数を加算していくわけじゃなくて、最長の12 年で出獄できる　ということだろう。

If someone’s convicted of committing more than one crime, they’re usually given a sentence for each crime.
Concurrent sentences are served at the same time.
Consecutive sentences are served one after the other - eg a 6 month sentence followed by a 3 month sentence.

Malaysia's former premier Najib Razak was on Tuesday (July 28) found guilty of all seven charges in the first of his five trials relating to the 1Malaysia Development Berhad (1MDB) scandal.

第一弾は、1MDB子会社から流出した金がナジブの銀行個人口座に入っていた　という事件だ。

( ナジブは　「個人口座に送金されたお金は　アラビアの王族からの献金だった」という主張をしていた。)

Najib is currently facing three separate 1MDB-linked trials, and the first finally reaches its climax this week in the Kuala Lumpur High Court.

The case centres on the transfer of RM42 million (S$13.6 million) from former 1MDB unit SRC International into Najib's bank accounts.

高裁の有罪判決に対して　ナジブは控訴するものと見られている。

But the 67-year-old is likely to appeal against any conviction, and may not be jailed straight away

今回の高裁判決は　1MDBナジブ関連裁判シリーズのうちの第一弾だが、金額ベースでは　第二弾の方が遥かに大きい。

The amounts involved in Najib's first case are small compared with those in his second and most significant trial, which centres on allegations that he illicitly obtained over US$500 million (S$691 million).
